TERMS OF USE

WELCOME TO KFCKU ("PLATFORM," "KFCKU APP," "APPLICATION," "SITE" WHICH CAN BE USED INTERCHANGEABLY OR HEREAFTER REFERRED TO AS "ONLINE SERVICE") OWNED AND MANAGED BY PT FAST FOOD INDONESIA TBK, A COMPANY LEGALLY ESTABLISHED AND SUBJECT TO THE LAWS OF THE REPUBLIC OF INDONESIA ("KFC INDONESIA," "KFCKU," OR "WE").

THE TERMS OF USE BELOW MUST BE READ BEFORE USING THE ONLINE SERVICE. BY ACCESSING THE ONLINE SERVICE PAGE, YOU ARE DEEMED TO HAVE READ, UNDERSTOOD, AND ACKNOWLEDGED YOUR ACCEPTANCE AND COMPLIANCE WITH THESE TERMS AND CONDITIONS, WHICH SHALL FORM A BINDING AND COMPLETE AGREEMENT BETWEEN YOU AND PT FAST FOOD INDONESIA, INCLUDING BUT NOT LIMITED TO CONFIDENTIALITY AND FAQ, WHICH ARE INTEGRAL PARTS OF THE TERMS OF USE.

YOU MUST BE AT LEAST SEVENTEEN (17) YEARS OLD OR HAVE PERMISSION FROM A PARENT/GUARDIAN TO USE THE ONLINE SERVICE, AND YOU ARE RESPONSIBLE FOR THE ACCURACY AND TRUTHFULNESS OF THE INFORMATION YOU PROVIDE. IF YOU OR YOUR PARENT/GUARDIAN DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY STOP USING THE ONLINE SERVICE AND REQUEST KFC INDONESIA TO CLOSE ANY ACCOUNTS YOU HAVE CREATED ON THE ONLINE SERVICE.

PLEASE NOTE THAT KFC INDONESIA MAY MODIFY, ADD, OR REMOVE THESE TERMS OF USE FROM TIME TO TIME WITHOUT PRIOR NOTICE. THEREFORE, YOU ARE RESPONSIBLE FOR REVIEWING THE TERMS OF USE OF THE ONLINE SERVICE YOU USE ON A REGULAR BASIS.

BY CONTINUING TO USE THE ONLINE SERVICE AFTER CHANGES ARE MADE, YOU, AS A VISITOR, REGISTERED USER, OR NORMAL USER ("YOU" OR "USER"), ARE DEEMED TO HAVE AGREED TO AND ACCEPTED SUCH CHANGES. THIS ALSO INDICATES YOUR ACCEPTANCE OF THE UPDATED ONLINE SERVICE TERMS. 1. SCOPE OF SERVICE

The Online Service is designed to provide various services to KFCKU customers. Some of the features provided by KFC INDONESIA include but are not limited to:

1. Order Service: Online and offline ordering for Kentucky Fried Chicken for delivery or pickup at outlets.

2. Loyalty Programs and Promotions: Special offers, birthday programs, and other promotions designed for loyal Kentucky Fried Chicken customers ("Services").

3. Information on store locations, menus, and the latest services.

4. User Account Management: Convenience to manage transactions and access exclusive offers.

5. Customer Service: Handling inquiries, complaints, or suggestions from users.

6. Membership: Paid or free membership programs for customers.

7. Chaki Kids Club: An exclusive program for children, including membership, special activities, and attractive offers.

8. Customized Orders for Special Events (Birthday Parties, Office Events, or Other Occasions) Birthday Party Packages.

9. And other services developed or made available from time to time.

2. KFC INDONESIA reserves the right to refuse service orders in accordance with applicable policies.

3. While KFC INDONESIA strives to provide the best service, KFC INDONESIA cannot guarantee that all information provided is accurate, complete, correct, or up to date. KFC INDONESIA is not responsible for any errors in information (including placement and typing mistakes), service interruptions (temporary and/or partial, damages, repairs, or app upgrades), inaccurate, misleading, or false information, or unclear information.

2. USER ACCOUNT

1. Before you can use certain services related to the Online Service, you may be required to register and create an account. You agree and warrant that all information you provide to KFC INDONESIA via the Service, including but not limited to contact information, registration details, or payment information, is true, accurate, and up-to-date. You also agree to maintain the accuracy of your account information and promptly notify KFC INDONESIA of any changes to your information, including but not limited to changes to your email address.

2. You are responsible for maintaining the confidentiality of your account and password or linked account, and you agree to be responsible for all activities that occur within your account. You acknowledge that your account is personal and agree not to give access to others to the Service or any part of it using your username, password, linked account, or other security information. You agree to immediately notify KFC INDONESIA of any unauthorized use of your account or any other security breaches that you become aware of. KFC INDONESIA is not responsible for any loss or damage you suffer due to the use of your account by others, whether with or without your knowledge. However, you may be held liable for losses suffered by KFC INDONESIA or others due to such unauthorized use.

3. By creating an account within the Service, you agree to receive communications from KFC INDONESIA electronically through the email address associated with your account. Although you may choose not to receive promotional communications, KFC INDONESIA retains the right to send emails containing information about your account or administrative notifications related to the Service.

4. You are strictly prohibited from selling, trading, or transferring your account (including but not limited to selling, trading, or transferring the email associated with the account). You are also not permitted to use someone else’s account without permission.

3. USER INFORMATION

1. You are required to provide the necessary information as per the Online Service you are using.

2. You may use the online messaging service with or without being registered in the membership service. Upon registering for KFCKU membership, you must provide a verifiable mobile phone number that can be contacted.

3. To join the loyalty program, you are required to create an account first.

4. Order history can only be accessed by users who have registered from the time of account registration.

5. You must provide supporting information as outlined in the KFCKU service form, either online or offline.

o Accurate delivery address

o Active email address

o Date of birth

7. Obligation for Accurate Information:

o You must provide truthful, detailed, complete, accurate, and non-misleading information.

o You must update and inform KFC INDONESIA of any changes. KFC INDONESIA reserves the right to request documentation to verify the information you have provided.

8. You are fully responsible for the truthfulness and accuracy of the information you provide.

9. You are required to use a PIN or OTP (One-Time Password) for login and transactions. The PIN or OTP must be kept confidential and not shared with others.

10. KFC INDONESIA has the right to suspend or delete your account if there is any violation of these terms and conditions.

2. Use of Account Personally:

# You may only use your own account.

# You agree not to allow anyone else to access your account or use your identity.

# You may not transfer or assign your account to any other party. You must maintain the security and confidentiality of your password and any identification provided to you by KFC INDONESIA. If your password is leaked or in any way causes unauthorized use of your account or identity, such orders will still be considered valid by KFC INDONESIA, unless you notify KFC INDONESIA of the issue before the service is rendered.

11. Inaccuracy of Information:

Market conditions or events may cause short-term changes that result in inaccurate information. In case of issues, KFC INDONESIA’s customer service will assist you in resolving them.

13. You promise to use the Online Service solely to obtain services. You are not permitted to misuse or use the Online Service for improper purposes, or to cause disruption to others or place fake orders.

14. Limited User License:

1. KFC INDONESIA grants the user a limited, non-transferable license ("Limited License") to access and use the Application as outlined in these Terms of Use.

2. All rights or licenses related to the ownership of the Application are fully owned by KFC INDONESIA or third parties providing licenses.

3. Content, including the software infrastructure in the Application, is the property of KFC INDONESIA, its affiliates, or service providers.

4. The user is only permitted to use the Application to place product orders and must ensure:

# The payment information, phone number, and contact details provided are accurate and correct.

15. Prohibited Unauthorized

1. You agree not to use the Application or any content within it for :

1. Commercial purposes, or

2. Purposes other than personal use, or

3. Any illegal purposes, or

4. Actions that violate these Terms of Use. You agree not to modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works, or resell any information, software, product, or service obtained in connection with the Application.

Additionally, you agree not to:

3. Take any actions that cause damage or harm to the Application or KFC INDONESIA’s infrastructure.

4. Create primary links to the Application (including but not limited to the ordering point) for any purpose without explicit written consent from KFC INDONESIA.

5. Resell, use, copy, surveil (such as using or deploying spiders or scrape programs), display, download, and/or create any content, software, product, or service through the Application for commercial purposes or competing activities.

6. Reproduce the Application (through "framing" or "mirroring") or arrange parts of the Application on any other web application without KFC INDONESIA’s consent.

7. Send announcements through the Application that violate laws, regulations, or support illegal or criminal activities.

8. Send or provide links that contain harmful, obscene, pornographic, offensive, violent, racist, discriminatory, insulting, threatening, harassing, oppressive, hateful, or unpleasant material.

9. Send or provide links to announcements containing slander, defamation, and falsehoods.

10. Send or make announcements that violate the intellectual property rights of KFC INDONESIA or any third-party intellectual property rights, including but not limited to copyrights, patents, trademarks, trade secrets, or confidential or public information.

11. Send announcements prohibited by applicable law or violate rights and obligations under contractual relationships.

12. Act as someone or a group, or provide false statements to others or entities for any relationship or use a false identity to deceive or mislead through this Application.

13. Manipulate or falsify information to obscure the source of statements you have made.

14. Use other applications that may damage, disable, disrupt, or interfere with the use of the Application or other users' equipment, or cause damage, disruption, or limit the functionality of any software, hardware, or communication equipment.

15. Gain unauthorized access or make unauthorized modifications to the Application or related websites, other accounts, computer systems, or networks connected by the Application by hacking, stealing passwords, or other similar means.

16. Gain or attempt to illegally obtain any material or information provided by the Application (including but not limited to other services provided by the Application), including obtaining or collecting information about others such as email addresses.

17. Engage in fraudulent activities to manipulate search engine results pages ("SERP") or perform search engine optimization ("SEO"). SEO practices considered unethical or "spamdexing" include but are not limited to cloaking, metadata, title tags, scraping content, link schemes, Google bombs, keyword searches, hidden text or hidden links, link schemes, spammy comments, and other practices.

18. Any other actions that may harm or cause damage to the Online Service, KFC, or its affiliates, employees, or reputation.

19. Unless explicitly permitted, you are not allowed to create any depth links other than the homepage of the Application or frames or webpages or any material contained therein, or links to aspects of the Application in email form for commercial purposes without KFC INDONESIA’s explicit written consent.

4. KFCKU APP APPLICATION

1. The KFCKU App may only be downloaded through official distribution platforms such as the Google Play Store, Apple App Store, or other platforms authorized by KFC INDONESIA. The use of the app downloaded from unofficial sources is entirely the responsibility of the user, and KFC INDONESIA is not responsible for any security risks or damages that may arise.

2. Some KFCKU services use user location data to provide optimal service. Users are required to provide accurate location data, which must not be manipulated. Users are prohibited from using third-party software or apps, including but not limited to mock GPS apps or location emulators, to manipulate the location data used by this app. KFC INDONESIA has the right to take action, including restricting access or closing accounts, against users found to have violated this rule.

5. MISUSE & FRAUDKFC INDONESIA

KFC INDONESIA reserves the right to investigate and take appropriate legal action against any individual or entity suspected of misuse or fraud related to the use of the Online Service. Misuse and fraud include, but are not limited to:

1. Identity Fraud & Account Fraud

o Impersonating another individual or using false information to register or transact.

2. Unauthorized Account Access

o Accessing or attempting to access another user's account without permission.

3. Using Automated Software or Methods

o Using automated software or methods to access, alter, or manipulate the KFCKU system.

4. Payment System Abuse

o Intentionally conducting transactions to cancel or avoid valid payments.

o Providing invalid or suspicious payment information.

o Performing unauthorized or intentional chargebacks on transactions already received.

5. Abuse of Promotions & Loyalty Programs

o Using coupons, discounts, or promotions fraudulently, including through forgery, unauthorized repeated use, or manipulation of the system.

6. Creating Multiple Accounts or Using False Information

o Creating multiple accounts or using false information to claim unauthorized benefits.

7. Platform & Content Abuse

o Uploading, sending, or spreading false, misleading, or harmful content via the Service.

o Distributing viruses, malware, or any other actions that may disrupt the operation of KFCKU or other users.

8. Violation of Laws & Regulations

o Using the Service for illegal or unlawful activities.

o Violating applicable laws, regulations, or policies related to the jurisdiction of service use

KFC INDONESIA has the right to restrict, suspend, or close accounts suspected of involvement in misuse or fraud without prior notice. Additionally, KFC INDONESIA may cooperate with legal authorities to take legal action against individuals or entities involved in such activities. If you suspect any fraudulent or abusive activities related to your account or transactions, immediately contact KFC customer service for further investigation.

KFC INDONESIA is not responsible for incidents of fraud or misuse carried out by third parties, including any losses or funds lost.

KFC INDONESIA is not obliged to refund payments or compensate for losses arising from such fraud, especially if it occurs due to the use of unofficial apps or servers or as a result of your own mistakes or negligence. If you detect unauthorized or suspicious orders, immediately contact KFC INDONESIA customer service for further handling.

6. PAYMENT METHODS

The price of Products or Services offered is in Indonesian Rupiah, unless explicitly stated otherwise. The prices listed do not include taxes or service charges, which are fully borne by the User.

KFCKU provides various payment methods that can be used to make transactions through the available services on the Online Service. By using the available payment methods, you agree to the following terms and conditions:

1. Payment Methods:

o Debit/Credit Cards

o Digital Wallets

o Cash: Accepted at certain KFC restaurants for direct purchases.

o Bank Transfers/Virtual Account Transfers

o KFC Vouchers: Can be used for payments under applicable terms and conditions.

o Third-Party Payment Services, such as DANA and/or Gopay and/or Banking Institutions/Other Payment Service Providers, must be used in your own name.

2. Payment Authorization and Verification:

o By linking a payment method to your user account, you agree that KFC may perform a temporary authorization to validate the payment method.

o You guarantee you are authorized to use the payment method for placing orders.

o The fees you incur will be accepted by the financial institution supporting the payment method, and you will pay all costs incurred in accordance with the listed price, including shipping and handling fees, as well as any applicable taxes, regardless of the quoted amount at the time of ordering.

o All purchases, orders, and fees authorized through the Service are subject to the terms and conditions set by the issuer of your payment method and the Payment Processor. You are responsible for complying with these terms and paying all related fees as imposed by the respective entities.

o If payment is declined or fails, KFC has the right to attempt to retry the charge without prior notice.

o You are responsible for ensuring that the payment method linked to your account remains active, valid, and has sufficient balance.

o Ensure the account has sufficient funds to cover the transaction costs.

o You are fully responsible for all financial obligations for transactions made under your name or through your account.

o KFC INDONESIA reserves the right to reject certain payment methods based on KFC INDONESIA policies.

o Service or administrative fees may apply depending on the chosen payment method.

o After you make full payment, KFC INDONESIA will process your order and provide order details according to the selected service.

3. Additional Fees and Taxes:

o All transactions may be subject to taxes according to government regulations.

o KFC is not responsible for additional fees that may be charged by your payment service provider, including international transaction fees or processing fees.

4. Payment Limits and Security:

o KFC has the right to set daily, weekly, or monthly transaction limits without prior notice.

o You are responsible for the security of your payment information and should not share your account or payment method details with others.

o If there is suspicious or unauthorized activity on your payment method, immediately contact KFCKU customer service.

7. ONLINE ORDERING

KFCKU offers an online ordering service to make it easier for customers to enjoy KFC INDONESIA products. By using this online ordering service, you are deemed to have read, understood, and agreed to the following terms and conditions:

1. Ordering Process

o Orders can be placed through the KFCKU Online Service or through Official Partners who have collaborated with KFCKU.

o You are not required to create an account or log in to place an order online, but ensure all information provided is accurate, complete, and up to date for smooth order processing.

2. Ordering Terms

o Product Selection: You can select from the available menu. Some products may have limited availability or be offered only at certain locations.

o Payment Methods: You can choose from the available payment methods, including debit/credit cards, digital wallets, or other methods offered on the platform.

3. Order Confirmation

o You will receive an order confirmation via the app. The order is considered valid when it is in the "confirmed" status, and the payment (either cash or non-cash) has been successfully processed.

4. Pick-up & Delivery Schedule

o Pick-up at Restaurant: You can choose to pick up your order at the KFC restaurant based on your selection. Please pay attention to the estimated order completion time.

o Delivery: If available, you can select delivery to a specified location. Delivery times depend on your location and the restaurant's policy.

o Additional delivery fees may apply, as per KFC or delivery partner policies.

5. Order Changes or Cancellations

o Once an order is confirmed, changes or cancellations can only be made within a specified time before the order starts being processed.

o If the order has been processed, cancellation is not possible unless under certain conditions defined by KFC.

o KFC reserves the right to reject orders due to technical issues, out-of-stock products, or other reasons. In such cases, your payment will be refunded according to the policy.

6. Order Errors

o Please ensure your order is correct before completing payment. KFC is not responsible for errors due to incorrect or inaccurate information provided by you.

o If KFC makes a mistake in fulfilling your order, you may contact customer service for a resolution.

7. Promotions & Discounts

o Certain promotions and discounts may apply to online orders. Terms and conditions for each promotion or discount will be provided on the ordering platform.

o Promotions are only valid within the specified period and locations.

By placing an order through the Online Service, you declare and guarantee that you are not subject to any restrictions or penalties under anti-money laundering regulations.

8. REFUNDS FOR TRANSACTION CANCELLATIONS

1. Refunds will only be processed according to KFC's policy and may be subject to certain limitations.

2. If you are eligible for a refund, KFC will issue it to your system balance, accessible through your user account, or via another refund method as per KFC's policy.

3. Transaction cancellations can be made before the order is processed. Once the order is processed, cancellations are not possible, except under specific conditions defined by KFC.

4. KFC’s Right to Cancel: KFC reserves the right to reject any user or order (or, in some cases, cancel order confirmation) at KFC's sole discretion, for any reason, and without providing an explanation. If your order is rejected or canceled by KFC INDONESIA and payment has been made, KFC INDONESIA will refund the amount charged without additional fees.

5. Refund Process:

o If your order is rejected or canceled by KFC, you can contact KFC Customer Service or the related outlet as per the previous order (or another outlet designated by KFC INDONESIA).

o Refund requests must be submitted within 3x24 working hours after cancellation.

o KFC will process the refund for the amount paid without additional fees within a maximum of 14 working days after the request is received, or according to the relevant bank terms.

o Customers will receive notification via email, the app, or other communication forms once the refund is processed.

o Refunds do not apply to errors caused by incorrect or inaccurate information provided by customers or incorrect menu selections.

o In some cases, administrative fees or penalties may apply, especially if the cancellation was caused by the customer’s mistake. The fee amount will be communicated before the refund process begins.

6. How to Apply for a Refund: To request a refund, customers must:

o Contact KFC Customer Service via email, phone, or live chat in the official app.

o Provide complete information regarding the order, such as the order number, purchase time, and reason for cancellation.

o Attach proof of payment or order confirmation (if requested).

o If the order involved promotions or discounts, the refund will only be for the amount paid by the customer, not the full product price.

o Promotions or discounts used cannot be refunded or transferred.

9. USAGE LIMITATIONS

Users are expected to comply with the following terms while using KFCKU services, both through the app and the official website:

1. Prohibited Uses Users are not allowed to:

o Use the service for illegal purposes, including but not limited to fraud, money laundering, or intellectual property violations.

o Access, hack, or disrupt the service system, app, website, or servers in any way.

o Use automated software, bots, or other methods to access or manipulate the service without KFCKU's consent.

o Misuse the service, such as using fake identities, unauthorized payment card data, or personal information belonging to others without permission.

2. Fair Use KFC INDONESIA reserves the right to deny or limit user access if suspicious or unusual activities are detected, such as:

o Large orders without prior notice.

o Repeated violations of service policies.

o Requests that could disrupt the system or operational services.

10. BATASAN TANGGUNG JAWA

1. Limitations and Claim Amount:

o Any claim you submit to KFC is limited to the total amount actually paid by you or owed to you during the event causing the claim.

o Under no circumstances will KFC INDONESIA and/or KFC licensees be liable to you or any third party for any costs, interest, damages, or losses in any form, including but not limited to personal injury, emotional distress, data loss, property damage, lost income, or economic loss.

2. Third-Party Liability Disclaimer:

o You explicitly release KFC INDONESIA from all liability, claims, or damages arising from or related to third parties.

o KFC INDONESIA is not a party to disputes between you and third parties and is not responsible for mediating or negotiating dispute resolutions.

o The decisions you make regarding the use of the Online Service are your sole responsibility.

o You explicitly release KFC INDONESIA from all liability, claims, lawsuits, or damages arising from the use of the Online Service, software, or interactions with third parties introduced through the Online Service.

11. INDEMNIFICATION

Under no circumstances, including any theory of liability (whether in contract, negligence (including negligence), statutory, or otherwise), shall KFC INDONESIA or any of its employees, subsidiaries, affiliates, agents, representatives, distributors, or licensors be liable for any damages, including but not limited to: (i) indirect, incidental, special, punitive, or consequential damages, (ii) death, personal injury, property damage, replacement costs of goods or services, loss of goodwill, business interruption, failure or damage to computers, loss of data, or loss of profits, and (iii) legal monitoring costs arising from or related to the use or inability to use the services, and KFC shall not be liable for damages resulting from false statements, errors, omissions, disruptions, deletion of files, mistakes, defects, viruses, delays in operation or transmission, or failure to perform, whether caused by events outside of KFC INDONESIA's reasonable control or not, including but not

limited to natural disasters, communication channel failures, theft, damage, or unauthorized access to records, programs, or services.

You hereby agree to indemnify and hold harmless PT Fast Food Indonesia Tbk, including its employees, affiliates, staff, and partners of KFC INDONESIA, from and against any and all claims, liabilities, damages, or losses, including but not limited to legal advisor fees, arising from third-party claims related to the following :

+ Your use of the Online Services.

+ Content provided, supplied, or accessed via the Online Services.

+ Your breach of these Terms of Use and KFC INDONESIA’s policies.

+ Violation of other rights and obligations; and/or

+ Any act or omission on your part, whether negligent, unlawful, or otherwise.

+ Violation of applicable laws and regulations in the Republic of Indonesia.

12. THIRD-PARTY LINKS AND CONTENT

The Online Services operated by KFC INDONESIA may contain links to websites operated by parties other than KFCKU. KFC INDONESIA does not control these sites or links and is not responsible for the content, privacy policies, or activities of those sites. KFC INDONESIA, or other third parties, may automatically upload search results or provide links to other sites. KFC INDONESIA allows third parties to provide, post, submit, or supply information, data, text, images, sounds, graphics, videos, messages, reviews, or other materials ("Content") via this Application. KFC INDONESIA does not review or control these sites, sources, and Content. alleged to be caused by or related to your use of or the Content, website, or sources.

13. TERMINATION

1. Termination Rights by KFC INDONESIA: KFC INDONESIA has full and absolute discretion to change, deactivate, or discontinue the Online Services and/or part of the Application, including services or products provided in the Online Services, and/or the use of this Application or part of the Application, at any time for any reason without prior notice to you.

2. Ongoing Obligations: In the event of termination, you remain bound by all obligations you have agreed to in these Terms of Use. This includes, but is not limited to, warranties, indemnities, releases, and liability limitations previously set out.

3. Release of KFC’s Liability:

o KFC INDONESIA is not liable to you or any third party for any termination or deactivation of your access to the Online Services.

o KFC INDONESIA is not liable for loss or damage of data due to the termination of the Online Services.

15. GOVERNING LAW

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Indonesia.

16. DISPUTES

+ These Terms and Conditions are drafted in both Indonesian and English. In case of any discrepancies between the English version and the Indonesian version, the Indonesian version will prevail.

+ In the event of any disputes arising from or relating to these Terms of Use, both parties shall attempt to resolve the matter amicably within sixty (60) calendar days from the date of notification of the dispute. However, if the dispute is not resolved within this period, it shall be submitted exclusively to the South Jakarta District Court.

17. GENERAL PROVISION

1. These Terms of Use govern the entire agreement and understanding between you and KFC INDONESIA regarding the subject matter of these Terms of Use and will supersede all prior agreements, both oral and written, between you and KFC INDONESIA regarding the subject matter.

2. Downloading and/or using the Online Services is free of charge. KFC INDONESIA may charge for downloading and/or the Application at any time, provided you are notified beforehand, allowing you to decide whether to continue using the service.

3. If you use the Online Services on behalf of a third party (such as family members or relatives), you are responsible for any inaccuracies in the information provided in relation to such use. Additionally, you must inform the third party of all applicable Terms of Use. When using the Application for and on behalf of a third party, you agree to indemnify and hold KFC INDONESIA harmless from any and all liabilities, damages, losses, litigation, and claims, including legal advisor fees, arising from or related to any breach of these Terms of Use by you and/or the third party.

4. If any part of these Terms of Use is declared invalid or unenforceable by a competent court, the remainder of the Terms will remain in effect to the extent permitted by applicable law. The invalid or unenforceable part will be replaced by a provision that closely reflects the original intent.

5. Failure by either party to enforce any provision of these Terms of Use in any circumstance shall not be construed as a waiver of the right to enforce such provision in any future instances.

6. You may not assign your rights or obligations under these Terms of Use without written consent from KFC INDONESIA.

7. KFC INDONESIA reserves the right to change or revoke these Terms of Use (in whole or in part) at its sole discretion. KFC INDONESIA may change these Terms at any time by posting an updated version on the Application. The latest version will supersede all previous versions.

8. Notifications under these Terms of Use are deemed to have been given if made in writing and delivered via registered mail, courier, or similar delivery service to either party (to the registered address of KFC INDONESIA or otherwise notified by KFC INDONESIA).

18. FORCE MAJEURE

1. KFC INDONESIA is not responsible for any non-performance or breach of these Terms of Use due to circumstances beyond its reasonable control ("Force Majeure Events"). These include but are not limited to natural disasters (floods, earthquakes), epidemics, riots, war declarations, military actions, terrorist actions, embargoes, sanctions, changes in laws or regulations, lightning, storms/cyclones, strikes, protests, and so forth.

2. KFC INDONESIA is not responsible for any damages or losses caused to any party if KFC INDONESIA is unable to process your order due to a Force Majeure Event.

19. INTELLECTUAL PROPERTY RIGHTS

Without limiting other intellectual property rights owned by Kentucky Fried Chicken International Holdings, INC and/or its Affiliates, the Online Services and its original content, including features and functionalities, are owned by PT Fast Food Indonesia, Tbk. Trademarks, service marks, trade names, and other similar rights are owned by Kentucky Fried Chicken International Holdings, INC and/or its Affiliates and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Any intellectual property rights within the Online Services, other than those owned by Kentucky Fried Chicken International Holdings, INC and/or its Affiliates, belong to their respective holders.

20. INTELLECTUAL PROPERTY RIGHTS

YOU ACKNOWLEDGE AND ACCEPT THAT, TO THE EXTENT PERMITTED UNDER APPLICABLE LAW:

2. FUNCTIONALITY, SERVICE, AND SECURITY:

o KFC INDONESIA DOES NOT WARRANT THAT: (I) THE FUNCTIONALITY, SERVICES, AND SECURITY FEATURES PROVIDED IN THE ONLINE SERVICES ARE FREE FROM INTERRUPTIONS OR ERRORS; (II) SUCH ERRORS OR INTERRUPTIONS WILL BE CORRECTED; OR (III) THE APPLICATION OR SERVER IS FREE FROM VIRUSES, MALWARE, OR HARMFUL COMPONENTS.

o KFC INDONESIA DOES NOT GUARANTEE THE ACCURACY, FUNCTIONALITY, INTEGRITY, OR QUALITY OF CONTENT, APPLICATIONS, OR RESOURCES AVAILABLE THROUGH THE ONLINE SERVICES, INCLUDING BUT NOT LIMITED TO THE ABSENCE OF NON-CONVENTIONAL, OBSCENE, OR CONTROVERSIAL MATERIAL.

o KFC INDONESIA DOES NOT GUARANTEE THE ACCURACY OF PRODUCT IMAGES OR VIDEOS DISPLAYED IN THE ONLINE SERVICES AS COMPARED TO THE PRODUCTS YOU RECEIVE DUE TO FACTORS LIKE PHOTOGRAPHY, LIGHTING, IMAGE
